On December 9 2022 the National Agency for Energy Regulation (ANRE) has finalized the procedure of provisional certification of the electricity transmission system operator (TSO) state enterprise (SE) Moldelectrica according to the certification model of "Independent System Operator."
The obligation to certify the electricity TSOs is a requirement of the European Union's Third Energy Package and Directive 2009/72/EC of the European Parliament and of the Council of July 13, 2009 on common rules for the internal energy market electricity.
As a Contracting Party to the Energy Community Treaty, the Republic of Moldova can benefit from guaranteed rights of contracting parties but also comply with all the obligations imposed by the treaty.
The provisional certification of the electricity TSO is part of a complex certification procedure. As soon as the Energy Community Secretariat provides a positive opinion on provisional certification, ANRE will issue its final decision on TSO certification, taking into account the potential recommendations of the Energy Community Secretariat.
Due to the TSO SE Moldelectrica efforts during all stages of certification procedure, the company has now confirmed its independence in relation to power companies that conduct activities of supply or production of electricity and gas. The TSO SE Moldelectrica will be financially, technically and physically independent in order to conduct its activities and mandatory duties, as an independent system operator.
According to the legislation, the state, represented by the Ministry of Infrastructure and Regional Development is the owner of the electricity transmission network. Under the national legislation the Ministry has assumed some obligations that include the cooperation and support provided to the independent system operator to fulfil its duties. The state shall provide to the TSO relevant information and guarantees that facilitate financing of possible extensions of the transmission network. However, the state will not get involve in the operational activity of the TSO.
The TSO SE Moldelectrica is the central dispatcher that manages the electricity transmission network using high voltage power lines.
